TANF - Legislation and Rules

The 1996 Federal welfare law provided states the option of adopting and implementing the Family Violence Option (FVO) to address the needs of domestic violence victims receiving welfare. Included below is the full text of the FVO in the Personal Responsibility and Work Reconciliation Act (PRWORA) of 1996, the Final Rule issued by HHS to Guide it's implementation, as well as information on the larger TANF bill. Also included is information related to the new TANF provisions in the Deficit Reduction Act of 2005.

Report on findings from a survey of 600 domestic violence, legal aid, and anti-poverty agency staff where 14% said that the TANF family violence responses work well in their states, and 43% said fewer than half of victims were able to access benefits.

Excerpts from the TANF Final Rule: Preamble and Regulations Related to Domestic Violence

On April 12, 1999, the U.S. Department of Health and Human Services (HHS) issued a final set of regulations to provide federal, state and tribal governments with direction in the administration of the Temporary Assistance for Needy Families program. Before issuing the Final Rule, HHS published a Notice of Proposed Rulemaking that included key provisions of TANF. The notice provided the public with an opportunity to submit comments regarding the proposed regulations.
