Press Release: Victim of Domestic Violence who faced Eviction Reaches Settlement With St. Louis Housing Authority

This press release describes a settlement between a survivor of domestic violence and the St. Louis Housing Authority. An ex-boyfriend and father stalked, harassed, and threatened the survivor, including breaking her apartment windows. She reported this damage to the police and the apartment manager and also obtained a protection order. After she showed the protection order to the apartment manager the survivor/tenant received a lease violation and a denial of her request to transfer apartments.

Discrimination in Metropolitan Housing Markets: National Results from Phase 1, Phase 2, and Phase 3 of the Housing Discrimination Study (HDS)

The Housing Discrimination Study 2000 (HDS 2000) represents the most ambitious effort to date to measure the extent of housing discrimination in the United States against persons because of their race or color. It is the third nationwide effort sponsored by HUD to measure the amount of discrimination faced by minority home seekers. The previous studies were conducted in 1977 and 1989.

A Step in the Right Direction: 2010 Fair Housing Trends Report

This report makes recommends to improve the state of fair housing in the U.S. Additionally, the 2005 report specifically addresses the nature and extent of racial segregation in the U.S. Advocates may find this report helpful for understanding FHIP and for baseline data on housing discrimination. The piece also concretely connects anti-oppression and economic advocacy work as it describes how racial discrimination and segregated housing are tied to wealth accumulation and social wellbeing across race and ethnicity.

State Law Guide: Housing Protections for Victims of Domestic and Sexual Violence and Stalking

This review lists state laws and recent legislative proposals addressing housing-related issues faced by survivors of domestic and sexual assault, including prohibitions on housing discrimination, defenses to eviction, termination of leases, and penalties for seeking police assistance. Quality Housing and Work Responsibility Act of 1998 514(e), Pub. L. No. 105-276 (codified at 42 U.S.C. 1437f note)

Providing the sense of Congress that, each public housing agency involved in the selection of eligible families for assistance under the United States Housing Act of 1937 (including residency in public housing and tenant-based assistance under section 8 of such Act) should, consistent with the public housing agency plan of the agency, consider preferences for individuals who are victims of domestic violence.

 

Bouley v. Young-Sabourin, (D. Vt. 2005)(Ruling on Cross Motions for Summary Judgment)

Bouley v. Young-Sabourin is a federal court case from Vermont involving a survivor of domestic violence evicted from her home after reporting an incident of domestic violence. The court ruling provides that discrimination against a victim of domestic violence, if proven, can be sex discrimination under the Fair Housing Act. Advocates may find this press story and court ruling helpful for public education purposes and for seeking non-punitive reactions by private and public landlords in their responses to survivors of domestic violence.

Department of Housing and Urban Development v. Rucker

This U.S. Supreme Court case is notable because it supports the idea that public housing authorities are required under U.S. law to have lease provisions that allow for eviction of tenant who is "innocent" of drug-related criminal activity, e.g. the tenant did not engage in the activity, did not know about the activity and/or it was not within their control. The Court explains that the U.S. Congress knew how to provide an "innocent owner" defense, but failed to do so in this instance.

Priced Out In 2012: The Housing Crisis for People with Disabilities

The report reveals the extreme housing affordability crisis for those people living on an SSI income. A state-by-state executive analysis shows the percent of SSI Benefits needed to rent a one-bedroom apartment as well as the housing market areas that require more than 100% of monthly SSI benefits. Local information is contained in the appendix. Policy recommendations round out this easy to read and digest report focusing on the disabled population and housing affordability.

Predatory Lending: The New Face of Economic Injustice

The document describes the discriminatory practices of predatory lending and their impact on African Americans and Latinos in particular. Analysis is offered as to the effects of predatory lending on the already disproportionate wealth gap between African Americans and whites and Latinos and whites. Mortgage lending, auto lending, and payday lending are all concisely reviewed.

Advocates may find this document helpful as a primer and tool for prioritizing and acting on issues that affect affordable housing.

Hitting the Wall: Credit as an Impediment to Homeownership

The authors find that while homeowner's credit quality improved between 1989 and 2001, renter's credit quality declined significantly. The report further indicates that the decline is more pronounced among the young, those with low income, and ethnic minorities.

Advocates may find this report helpful for its review of research covering the intersection of credit and homeownership. It also indicates that education may be critical to credit quality and homeownership opportunities.

Credit Counseling in Crisis: The Impact on Consumers of Funding Cuts, Higher Fees and Aggressive New Market Entrants

It includes data and statistics, history, an analysis of common problems, and recommendations for change. Information in the report pre-dates the final passage of bankruptcy reform, yet still has application in terms of understanding the industry and reforms that need to be considered. Consumer materials on selecting a credit counseling agency are provided. The report includes a 3-page executive summary.
